This privacy policy (“Privacy Policy”) explains the types of information Satellos may collect about you when you visit a Satellos Site (“Site”) and/or access or use other Satellos’ mobile or desktop applications and/or additional services offered by Satellos, whether online or otherwise (collectively the “Services”). It also outlines how Satellos may use and disclose your information, how you can control the use and disclosure of your information, and the ways Satellos protects your personal information. By accessing and/or using the Services, you accept and agree to the terms of this Privacy Policy. Satellos is accountable for personal information under its control and has implemented internal policies, procedures, and training programs to ensure the protection of personal information. Satellos collects and processes only the personal information strictly necessary to fulfill the specific legitimate purposes described in Section 3. of this Privacy Policy. In particular, Satellos may collect and process the following types of personal information:
Personal information you disclose to us
Satellos collects personal information that you provide during your interactions with us via the Site and Services, depending on the choices you make. Special note for individuals interested in participating in Satellos’ clinical trials
One of Satellos’ main activities in the current stage of development is conducting clinical trials in the area of Duchenne Muscular Dystrophy. If you or any of your family members are interested in participating in Satellos’ clinical trials, please refrain from contacting Satellos directly through the contact form available on the Site or any other means of communication, and from sharing private health information through these channels.
When conducting clinical trials, in accordance with international regulations and laws, sponsor companies such as Satellos are only permitted access to coded information related to the individuals enrolled in these trials. This is an important measure for protecting your privacy. By communicating with Satellos directly, your privacy will be unintentionally breached. Please make sure to refrain from such communication for the reasons explained in this section.
3. HOW DO WE USE YOUR INFORMATION?
Satellos collects, processes and uses your personal information for specified, relevant, and legitimate business purposes (“Business Purposes”), with your consent and/or to comply with our legal obligations (“Legal Reasons”). We use the information we collect or receive:
- In connection with our research and development of innovative products.
- To send you information for Business Purposes. If you receive general emails from us, you can opt-out of our emails at any time using the unsubscribe feature at the bottom of any email, however in doing so it may limit the Services available to you.
- To send administrative information to you for Business Purposes or Legal Reasons. We may use your personal information to send you clinical and product updates, and other information including about changes to or enforcement of our Site terms, conditions, and this Privacy Policy.
- For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Site, materials, products, services, and your experience. We collect and use personal information only for purposes that a reasonable person would consider appropriate in the circumstances. Your information will not be used in a way that is incompatible with these purposes without first obtaining your consent.
4. WILL YOUR INFORMATION BE SHARED WITH ANYONE?
Satellos shares and discloses your information in the following situations:
- Compliance with Laws. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
- Vital Interests and Legal Rights. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies (including the Terms of Use), suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

We, along with third-parties such as Google, may also use cookies (such as the Google Analytics cookies and DoubleClick cookies) or other identifiers together to compile data regarding traffic throughout the Site so we can improve the Site for the best user experience. Users can set preferences by using the Google Settings page or opt out by using the Google Analytics Opt Out Browser add on. All data collected through Google services is subject to Google’s own privacy policies.
7. HOW LONG DO WE KEEP YOUR INFORMATION?
We keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it. Or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
Satellos implements technical and organizational security measures that are designed to protect the security of any personal information we collect and process. However, we cannot guarantee security or safety since the internet is not 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Site is at your own risk. We recommend that you only access the Services within a secure environment.
You should also refrain from contacting Satellos directly, through the contact form available on the Site or any other means of communication, when you or your family members are interested in participating in clinical trials conducted by Satellos. For more information on this measure to keep your information safe, please read carefully the Special note for individuals interested in participating in Satellos’ clinical trials available in Section 2. above in this Policy.

9. DO WE COLLECT INFORMATION FROM MINORS?
We do not knowingly solicit data from or market to children under 18 years of age. By using the Site, you represent that you are at least 18 or that you are the parent or guardian of the minor dependent, and consent to such minor dependent’s use of the Site and/or Services. If we learn that personal information from users less than 18 years of age has been collected without consent, Satellos will deactivate the account and take reasonable measures to promptly delete such information from our records. 10. WHAT ARE YOUR PRIVACY RIGHTS?
Under various privacy laws, you have a right to obtain details about the personal information that Satellos has about you, and to request correction and amendment, and possibly delete information in accordance with applicable laws.
If at any time you would like to know what personal information Satellos has collected and holds about you, if any, please email privacy@satellos.com. We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the personal information that we hold about you, or we may have destroyed, erased, or made your personal information anonymous in accordance with Satellos’ record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions. In addition, where disclosure might reveal personal information of another individual, confidential business information, information protected by solicitor-client privilege, or information that was collected in the course of a formal dispute resolution process or in relation to the investigation of a breach of an agreement or contravention of a law or regulation, Satellos may not provide access to all of the information available. We are committed to responding to access requests within 30 days from their receipt. If an extension is necessary, we will notify you and provide the reasons for the delay.
Where the processing of your personal information is based on your consent, you may also withdraw consent for Satellos to use your personal Information by contacting Satellos at the contact email below, however a withdrawal of consent is not retroactive. In addition, Satellos is obligated to retain certain information as prescribed by law. No personal information is made public by Satellos and nor does Satellos trade or sell your personal information. To exercise this right, you can contact Satellos at privacy@satellos.com
Satellos collects your email address for email subscriptions, when you provide it via the ‘contact’ form on the Site, in order to send information, respond to inquiries, and/or other requests or questions. It does not send unsolicited emails, and allows those who receive a news style of email to unsubscribe by using the link at the bottom of each email. If at any time you would like to unsubscribe from receiving future emails, please follow the instructions at the bottom of an email and Satellos will promptly remove you from the relevant email list.
Moreover, you have the right to request the correction of an error or omission in your personal information that is under the control of Satellos. You can exercise this right by sending an email to privacy@satellos.com

11. DO WE MAKE UPDATES TO THIS POLICY?
We may update this privacy policy from time to time. The version will be indicated by the date at the top of the page, and the updated version is effective as soon as it is accessible. This section of the Policy is relevant to you, if you are visiting our Site and using our Services from the EEA or the UK. Certain additional legal requirements apply in these jurisdictions, and those are outlined below. Except as otherwise stated in this section, the remainder of this Privacy Policy continues to apply regardless of your location. In the event of any conflict between this EU/UK-Special section and other parts of the Privacy Policy, the provisions in this section shall prevail for users in the EEA and UK.
PROCESSING OF PERSONAL DATA

The legal basis for processing your Personal Data for Satellos’ Business Purposes (described in Section 3. of the Policy) is Satellos’ legitimate interest in conducting business and promoting its activities to the public.
Satellos uses the legal basis of consent to process any of your Personal Data, based on communication you have initiated with Satellos, through Satellos’ contact form or any other means of communication.
Finally, and as described in Section 3. of the Policy, Satellos may under certain circumstances collect and process your personal data to comply with its legal obligations.

CROSS-BORDER TRANSFERS OF YOUR PERSONAL DATA
As a Canadian-based company, Satellos might transfer your Personal Data to Canada, which is a country outside the EU or the UK. However, Canada is covered by an adequacy decision issued by the European Commission in the EU and by the Secretary of the State in the UK, meaning that it has been recognized as offering the same level of data protection as in the Applicable Data Protection Laws.
At the same time, some of the Recipients of your Personal Data of this Policy can be based outside the EU or the UK in countries not covered by an adequacy decision. For these cases, Satellos has put in place appropriate safeguards to ensure that your Personal Data will be protected adequately in these third countries, such as by signing Standard Contractual Clauses in its agreements with Vendors, Consultants and Other Third-Party Service Providers, or by following any of the measures listed in Chapter V of the GDPR and the UK GDPR.
